WV Proof of Residency: Accepted Documents, Affidavit, and Deadlines

To get a West Virginia driver’s license or state ID, you need two documents showing your full legal name and a physical West Virginia street address. The Division of Motor Vehicles calls this WV proof of residency, and it splits the accepted documents into two groups with strict rules about how you combine them.

The Two-Document Rule

The DMV keeps two lists, called List B and List C. You have two valid options: bring two documents from List B, or bring one from List B paired with one from List C. Two List C documents together will not work.¹

One more rule catches people: the two documents cannot come from the same company. Two bills from your electric company won’t count as two proofs, even if one is a bill and the other is a service notice. You need two different sources.

Every document must display your full legal name and a physical West Virginia street address. P.O. boxes are not accepted.

List B: Primary Residency Documents

List B holds the stronger records that carry the most weight with the DMV.¹

Utility bills for electric, water, or gas, dated within the last 60 days. Termination notices do not count.
Housing records: a mortgage document, homeowner’s insurance policy, proof of home ownership, or a signed residential lease.
Any tax document showing a West Virginia street address.
A W-2 form no more than 18 months old.
Government-issued records: a West Virginia voter registration card, weapons permit, homestead tax exemption, proof of public assistance, or a valid WV vehicle registration card.
A completed Affidavit of West Virginia Residency (see below).

List C: Supplementary Documents

List C documents only work as a second proof, paired with something from List B.¹

A paycheck stub from a West Virginia employer showing your physical address. Handwritten stubs are not accepted.
A West Virginia bank statement or auto insurance card.
A letter from a homeless shelter, nursing home, rehabilitation center, or similar facility confirming that you reside there.
A Social Security benefits letter.
A college admissions letter showing in-state status.
A West Virginia hunting license or professional license.
A U.S. Selective Service card.
A 911 address assignment letter from the post office.

Documents That Don’t Qualify

Cell phone bills are not on either list. They feel like utility bills, and applicants routinely bring them, but the DMV does not treat them as one. Anything sent to a P.O. box will also fail, since the requirement is a physical street address. And two documents from the same provider count as one source, so a bill and an account statement from your electric company together will not satisfy the rule.

If Nothing Is in Your Name: The Residency Affidavit

Plenty of people live at an address without having any accounts in their own name. Young adults still at home, students, someone who recently moved in with a partner or family member. For this situation, the DMV accepts the Affidavit of West Virginia Residency.

The form has two sections. You complete Section A. The homeowner or primary account holder completes Section B, swearing under oath that you live at their address. Both parties sign. That homeowner must also bring two of their own qualifying residency documents to the DMV, and they must appear in person with you. A pre-signed affidavit without the other person present will be rejected. The form itself warns that false statements can lead to criminal and civil penalties, including suspension or cancellation of the license or ID.²

REAL ID Uses the Same Residency Rule

Federal REAL ID enforcement began on May 7, 2025. Without a REAL ID-compliant license or ID, marked with a gold star, you cannot board a domestic flight or enter certain federal buildings on your state credential alone. A valid passport still works as an alternative at TSA checkpoints.³

For residency, a REAL ID uses the same two-document requirement as a standard license, drawn from the same lists and subject to the same different-company rule.⁴ The added burden for REAL ID is on the identity side: a certified birth certificate or valid passport, plus proof of your Social Security number. Bring everything at once.

The 30-Day Deadline for New Residents

West Virginia gives you 30 days after establishing residency to apply for a state driver’s license.⁵ The same 30-day window applies if you’re transferring an out-of-state license.⁶ The clock starts when you move in, not when you find time to visit the DMV. That’s the practical reason to line up your two residency documents early.

Military Members and Spouses May Not Need WV Documentation

Federal law says a service member cannot lose or gain a state of residence for tax purposes solely because military orders send them somewhere new. Active-duty members stationed in West Virginia don’t automatically become WV residents, and West Virginians stationed elsewhere don’t lose their residency.⁷

The same protection covers military spouses who move to West Virginia solely to be with a service member under orders. Married couples can also elect to use either spouse’s home state or the service member’s permanent duty station as their state of residence. If you’re maintaining legal domicile in another state under these protections, you may not need a West Virginia license at all. Check with your installation’s legal assistance office before assuming either way.⁷
