West Virginia residential parking laws come from two places at once: a state statute that lists specific spots where you can never park, and local ordinances your city or town layers on top for permits, time limits, and snow emergencies. The state rules apply whether or not a sign is posted. First-offense fines generally top out at $100, climb to $200 for a second violation within a year, and reach $500 for a third, with accessible-space and abandonment violations carrying much heavier penalties.
Where You Cannot Park on a Residential Street
West Virginia Code 17C-13-3 bans stopping, standing, or parking in a long list of locations on any public road in the state. No sign is required for enforcement. The locations most likely to catch a residential driver are:1West Virginia Legislature. West Virginia Code 17C-13-3 – Stopping, Standing or Parking Prohibited in Specified Places; Penalty
- Within 15 feet of a fire hydrant.
- On a crosswalk, within an intersection, or within 20 feet of a crosswalk at an intersection.
- Within 30 feet of a flashing beacon, stop sign, or traffic signal at the side of the road.
- Within 50 feet of the nearest rail at a railroad crossing.
- Within 20 feet of a fire station driveway, and within 75 feet across from one if signs are posted.
- In a designated fire lane.
- Within 20 feet of a mail receptacle if parking would delay a carrier using a vehicle.
- On a sidewalk.
- In front of a public or private driveway.
- In front of a wheelchair-accessible curb cut marked with blue paint.
- On the roadway side of a vehicle already parked at the curb (double parking).
- On any bridge, elevated structure, or inside a tunnel.
- Alongside a street excavation or obstruction in a way that blocks traffic.
The driveway rule applies even to the driveway you own. The right-of-way in front of it has to stay clear for other drivers, pedestrians, and emergency crews, and blocking a neighbor’s driveway is one of the fastest routes to a citation. The hydrant distance and the 20-foot crosswalk setback are the two measurements that quietly turn a convenient curb spot into a ticket, especially in older neighborhoods where hydrants sit close to the usable curb.
How to Park at the Curb
State law also controls your position in the space. West Virginia Code 17C-13-4 requires your right-hand wheels to be parallel to and within 18 inches of the right-hand curb.2West Virginia Legislature. West Virginia Code 17C-13-4 – Additional Parking Regulations Parking against traffic puts your left wheels at the curb and is a violation.
Two local exceptions exist. A municipality can authorize left-side parking on one-way streets, and it can allow angle parking on streets wide enough to support it. Angle parking is never allowed on a state highway unless the Division of Highways has approved it. Absent signs saying otherwise on a residential street, the default is right side, parallel, within 18 inches.
Accessible Parking Spaces
Parking in a space reserved for people with disabilities without proper authorization is punished separately and much more severely. Under West Virginia Code 17C-13-6, the fines are $200 for a first conviction, $300 for a second, and $500 for each one after that. A valid accessible placard or plate is required, and expiration dates on temporary placards do get checked.
What Your City or Town Adds
West Virginia Code 17C-2-8 lets local governments regulate parking on streets within their jurisdiction as part of their general police power.3West Virginia Legislature. West Virginia Code 17C-2-8 – Powers of Local Authorities Local authorities cannot authorize parking on a state highway or install traffic devices on one without written approval from the state road commissioner.4FindLaw. West Virginia Code 17C-2-8 – Powers of Local Authorities The day-to-day rules you actually encounter on your block (time limits, permit zones, street sweeping windows, overnight bans) usually come from your municipality rather than from Charleston.
Residential Permit Zones
Some West Virginia municipalities operate residential permit programs that reserve street parking for verified residents, usually with a sticker or hangtag displayed on the vehicle. Costs vary. Parking in a designated zone without a valid permit results in a citation.
Snow Emergencies
Towns with regular snowfall declare snow emergencies that ban parking on designated routes during and after storms. Charles Town activates its emergency when forecasts call for more than four inches or when officials determine an ice emergency exists, and vehicles left on a snow emergency route during an active declaration can be towed, with a minimum $100 fine per offense.5American Legal Publishing. Local Fine Schedules
Municipal fines for common infractions are often lower than the state statutory maximum for a first offense, at least until late fees start running. Morgantown charges $5 for an expired meter, $20 for parking in a restricted area or without a permit, $30 for parking on a sidewalk or in a fire lane, and $105 for an accessible parking violation.6Morgantown, WV. Parking Citations Charles Town uses escalating late fees; a $10 meter ticket becomes $30 after five days and $60 after thirty.7American Legal Publishing. Abandoned and Inoperable Vehicles
Leaving a vehicle on a public street or on private property without the owner’s consent is a misdemeanor under West Virginia Code 17-24A-2.8West Virginia Legislature. West Virginia Code 17-24A-2 – Abandonment of Motor Vehicle Prohibited; Penalty Fines scale with weight:
- Under 100 pounds: $50 to $1,000, or 8 to 16 hours of community service, or both.
- 100 to 500 pounds: $500 to $2,000, or 16 to 32 hours of community service, or both.
- Over 500 pounds: $2,500 to $25,000, or up to one year in jail, or both.
Nearly every passenger vehicle falls in the top tier. A second or subsequent violation doubles the fine range and community service hours. Municipalities also set their own abandonment thresholds; Morgantown treats any vehicle with expired registration or one left in place more than 48 hours as abandoned and attaches a $30 fine.6Morgantown, WV. Parking Citations The state statute lets officials take possession and notify the owner and any lienholder; unclaimed vehicles can be lost entirely. If you have a project car or a non-runner, keep it on private property.
Private Property and HOAs
The state’s parking prohibitions apply on public roads and property. On private land, different rules take over. West Virginia Code 17C-14-13 lets a property owner, tenant, or lessee remove a vehicle parked on their private road, driveway, or property without liability for the removal cost, provided the removal is not negligent, and the vehicle owner pays. The person doing the removal has to notify the State Police, and local police inside a municipality.9West Virginia Legislature. West Virginia Code 17C-14-13 – Removal of Vehicles From Private Property
Homeowners associations and maintenance associations add rules of their own. Under West Virginia Code Chapter 7, Article 12A, county commissions can approve maintenance associations for shared infrastructure like private streets, and the governing documents must include enforcement provisions.10West Virginia Legislature. West Virginia Code 7-12A – Maintenance Associations HOA covenants commonly restrict commercial vehicles, boats, and RVs in driveways or common areas and impose their own fines. Those rules are enforced through the association and civil court, not police citations. If you live under an HOA, read the CC&Rs; state parking law is not the only set of rules that applies to you.
What a Ticket Costs
Violating Section 17C-13-3 or 17C-13-4 is a misdemeanor. The statutory maximum fines rise with repeat offenses in a one-year window:1West Virginia Legislature. West Virginia Code 17C-13-3 – Stopping, Standing or Parking Prohibited in Specified Places; Penalty
- First offense: up to $100.
- Second offense within one year: up to $200.
- Third or subsequent offense: up to $500.
Accessible-space violations run on the separate, steeper schedule described above.
Towing and Boots
Vehicles blocking a hydrant, fire lane, driveway, or active snow emergency route can be towed. On top of the ticket, you pay the hookup, daily storage, and any administrative charges, and those costs generally have to be settled before the vehicle is released. Some jurisdictions boot cars whose owners have multiple unpaid tickets, adding a removal fee to the bill.
Driving Record
Standard parking tickets do not add points to your West Virginia driving record. The point system covers moving violations, not citations against a parked vehicle, and your insurance rates should not be affected by one.
Contesting a Citation
If you think a ticket was wrong, you can contest it in municipal court. The procedure is local; Morgantown has you appear on the date printed on the ticket, while Wheeling requires completing a Personal Recognizance Bond Form and contacting the Municipal Court Clerk before filing it.11City of Wheeling, West Virginia. Municipal Court Follow the instructions printed on the citation or call the court clerk.
Ignoring a ticket is the most expensive option. Late fees accumulate, and unresolved citations can get your car booted or towed the next time it is spotted on a public street. A legitimate defense is worth the hour it takes to show up.
