West Virginia sales tax exemptions cover a long list of everyday purchases and business transactions, from groceries and prescription drugs to items bought for resale or used directly in farming and research. The state’s 6% consumers sales and service tax (plus up to 1% in some municipalities) applies to most retail sales, but W. Va. Code § 11-15-9 and related statutes carve out dozens of categories. Some exemptions apply automatically at the register. Others require you to hand the seller a completed exemption certificate, or to pay the tax and claim a refund later.
Exemptions That Apply Automatically
Several consumer purchases are exempt at the point of sale, with no paperwork from you. The main ones under § 11-15-9(a):
- Prescription drugs, insulin, durable medical equipment, mobility-enhancing equipment, and prosthetic devices.
- Food for home consumption. Prepared foods, candy, soft drinks, and dietary supplements stay taxable at the full rate.
- Textbooks required for use in West Virginia schools or qualifying nonprofit educational institutions.
- Gas, steam, water delivered through mains or pipes, and electricity.
- Newspapers delivered to consumers by route carriers.
- Lottery tickets and materials.
You don’t need to show anything to avoid tax on a filled prescription or a grocery run. The cashier’s system handles it.1West Virginia Legislature. West Virginia Code 11-15-9 – Exemptions
Professional Services Are Not Taxed
West Virginia’s sales tax reaches many services, but professional services are specifically excluded. The state regulation lists physicians, dentists, lawyers, certified public accountants, architects, professional engineers, veterinarians, pharmacists, licensed real estate brokers, and roughly two dozen other licensed professions whose services are not subject to the consumers sales and service tax.2Legal Information Institute. West Virginia Code R. 110-15-8 – Furnishing of Services Included
The split matters when a licensed professional also sells goods. The professional fee is exempt; tangible property sold alongside it is not. A veterinarian’s exam fee is exempt, but the bag of pet food from the front counter is taxable.
Government and Nonprofit Purchases
Purchases by the federal government, the State of West Virginia, and political subdivisions like counties and municipalities are exempt when used for public purposes. Other states’ governmental units also qualify, but only if their home state extends the same courtesy to West Virginia.1West Virginia Legislature. West Virginia Code 11-15-9 – Exemptions
Churches that charge nothing for their services receive a separate exemption for supplies, equipment, and food used directly in their operations. Gasoline and special fuel do not qualify, even for a church.1West Virginia Legislature. West Virginia Code 11-15-9 – Exemptions
What a 501(c)(3) or 501(c)(4) Must Prove
Nonprofits don’t get the exemption just because they hold federal tax-exempt status. All four of these conditions must be met:
- A current business registration certificate from the West Virginia State Tax Department.
- Federal income tax exemption under IRC § 501(c)(3) or § 501(c)(4).
- Qualifying organizational type: a church or association of churches; an elementary or secondary school with regular faculty and enrolled students; an organization receiving more than half its support from gifts, grants, or contributions; a youth organization such as the Boy Scouts or Girl Scouts; or an all-volunteer organization that donates its net fundraising income to another qualifying exempt entity.
- Use of the items in activities for which the organization qualifies for its federal exemption.
One trap: a volunteer or employee who buys with personal funds and gets reimbursed is not covered. The organization has to pay the vendor directly from its own accounts.3West Virginia Tax Division. TSD 320 – Sales and Use Tax for Nonprofit Organizations
Business Exemptions: Resale, Agriculture, R&D
Three business-side exemptions do most of the day-to-day work.
Resale. If you buy tangible personal property to resell it, you don’t pay sales tax on the purchase. Tax gets collected when the final consumer buys the product. Retailers, wholesalers, and distributors use this exemption constantly. You claim it by giving your supplier a completed exemption certificate indicating the purchase is for resale.1West Virginia Legislature. West Virginia Code 11-15-9 – Exemptions
Agricultural production. Tangible personal property and taxable services used directly in the commercial production of an agricultural product are exempt. Seeds, livestock feed, fertilizer, and farming equipment qualify. The word “directly” is doing real work: a tractor working the field qualifies, but equipment sitting in a farm office doesn’t.1West Virginia Legislature. West Virginia Code 11-15-9 – Exemptions
Research and development. W. Va. Code § 11-15-9b exempts tangible personal property and services directly used or consumed in R&D. The “directly used” standard here is strict: the property must be physically incorporated into, cause a change upon, or otherwise be integral to the R&D process. Lab equipment and testing materials qualify. Office supplies for the R&D department do not. Unlike the resale exemption, you either pay the tax first and apply for a refund, or give the vendor a West Virginia direct pay permit number.4Justia Law. West Virginia Code 11-15-9b – Research and Development Exemption
Direct Pay Permits
Businesses that make complex or high-volume purchases can apply for a direct pay permit under W. Va. Code § 11-15A-3d. With the permit, you skip paying tax to your vendor and instead remit it directly to the Tax Commissioner. It’s useful when the taxability of a purchase depends on how you ultimately use the item, which you may not know when you buy it.
The Tax Commissioner issues permits case by case. Once granted, your permit runs through the end of your registration year and renews automatically with your business registration certificate unless you surrender it or the Commissioner cancels it.5West Virginia Legislature. West Virginia Code 11-15A-3d – Direct Pay Permits
The Annual Sales Tax Holiday
West Virginia holds a sales tax holiday each year beginning on the Friday before the first Sunday in August and running through the following Monday. In 2026, it runs from 12:00 a.m. Friday, July 31 through 11:59 p.m. Monday, August 3. During that window, qualifying purchases in categories like clothing and school supplies are exempt from the state sales tax.6West Virginia Tax Division. Business – West Virginia Tax Division
The holiday applies at the state level. Whether your municipality also suspends its local 1% tax during the same period is worth checking before you plan a large purchase around it.
How to Claim an Exemption at the Register
For most business-related exemptions, you give the seller a completed Streamlined Sales Tax Certificate of Exemption, Form F0003. This is the standard form used by states participating in the Streamlined Sales and Use Tax Agreement, and West Virginia accepts it.7West Virginia State Tax Department. Streamlined Sales Tax Certificate of Exemption
The form asks for:
- Purchaser and seller legal name and address.
- A tax ID, either a West Virginia Sales and Use Tax account number or a Federal Employer Identification Number.
- Business type (retail, wholesale, manufacturing, agriculture, and so on).
- Reason for exemption: resale, agricultural production, use by an exempt organization, or another qualifying purpose.
Download the form from the West Virginia State Tax Department’s website. Fill every field. An incomplete or obviously wrong certificate gives the vendor grounds to refuse it and charge you the full tax. When the form is properly completed and the stated exemption is plausible for the type of purchase, the vendor accepts it in good faith and doesn’t collect the tax.
Getting a Refund for Tax You Already Paid
If you paid sales tax on a purchase that qualified for an exemption, file Form CST-240, the Claim for Refund or Credit of Consumer Sales Tax Paid to a Vendor. You can mail it to the West Virginia Tax Division in Charleston or file online through the MyTaxes.WVtax.gov portal.8West Virginia Tax Division. CST-240 Instructions – Claim for Refund or Credit of Consumer Sales Tax
Attach copies of every invoice or credit memo that supports your claim. Claims involving more than 25 exempt items require a specific import spreadsheet submitted electronically. The deadline is three years from the date the return was due, or two years from the date you paid the tax, whichever is later. Miss that window and the refund is gone.8West Virginia Tax Division. CST-240 Instructions – Claim for Refund or Credit of Consumer Sales Tax
Penalties for Claiming an Exemption You Don’t Qualify For
Issuing a false or fraudulent exemption certificate has real costs. A purchaser who claims an exemption improperly can be held for the unpaid tax plus penalties and interest. West Virginia imposes penalties that can reach 5% of the tax due per month for intentional disregard of the rules, and a false or fraudulent return can trigger a penalty of up to 50% of the underreported tax.
Honest mistakes, like checking the wrong business type, are correctable. Systematically claiming the resale exemption on goods you actually use in your business is the pattern that gets flagged in audits and escalated.
Don’t Forget Use Tax on Out-of-State Buys
West Virginia’s use tax is the companion to its sales tax. If a remote seller doesn’t charge West Virginia sales tax on a taxable item, you owe the use tax yourself. Individuals can report it on their personal income tax return.9West Virginia Tax Division. Remote Sellers and West Virginia Sales and Use Tax
The exemptions that apply to the sales tax apply to the use tax as well. If the item would have been exempt in-state, you don’t owe use tax on it. Taxable office furniture from an out-of-state vendor that doesn’t collect West Virginia tax, by contrast, carries 6% (plus any municipal rate) when you file.
