There is no single answer to whether a West Virginia state of emergency is in effect today, because declarations start and end on short notice and can cover the whole state or just a few counties. To confirm current status, check the Governor’s office and the West Virginia Emergency Management Division at emd.wv.gov; county emergency management offices post local declarations that may add restrictions on top of any statewide order. Whenever a declaration is active, a specific set of legal protections and restrictions turns on automatically, and knowing which ones affect you matters more than the label on the proclamation.
State of Emergency vs. State of Preparedness
West Virginia Code Section 15-5-6 gives the Governor two declaration options. A State of Emergency signals an active crisis requiring immediate response. A State of Preparedness sits a step below, used to pre-position resources when a threat is approaching but has not fully hit.1West Virginia Legislature. West Virginia Code 15-5-6 – Proclamation of a State of Emergency or State of Preparedness Both trigger the same expanded gubernatorial authority, and both switch on the state’s price gouging protections.
The two differ in how long they can last. A State of Preparedness has a statutory hard cap of 30 days, whether or not anyone formally ends it. A full State of Emergency has no comparable automatic expiration and continues until the Governor issues a termination proclamation or the Legislature ends it by concurrent resolution.1West Virginia Legislature. What Turns On the Moment a Declaration Is Issued
Price Gouging Cap
The most immediate consumer protection kicks in automatically the moment either type of declaration is proclaimed. Businesses and contractors cannot raise prices on essential goods and services by more than 10% above what they charged 10 days before the declaration. Violations are misdemeanors carrying a fine of up to $1,000, up to one year in jail, or both.2Office of the West Virginia Attorney General. Save receipts and photograph shelf prices; that is the evidence the AG’s office works from.
Evacuations, Curfews, and Travel Restrictions
Under the same statute, the Governor can compel evacuation of all or part of the population from a stricken or threatened area and arrange care for evacuees. The Governor can also control who enters and leaves a disaster area, restrict movement within it, and regulate the occupancy of buildings there.1West Virginia Legislature. West Virginia Code 15-5-6 – Proclamation of a State of Emergency or State of Preparedness Ignoring an order issued under an active declaration, including an evacuation order, can result in misdemeanor charges. Counties can layer additional restrictions on top, so local orders are worth checking even when the state order looks straightforward.
If You Are Ordered Out of Your Home
A mandatory evacuation is the point at which homeowner’s insurance becomes urgent. Most standard policies include Additional Living Expenses (ALE) coverage, which pays the extra cost of temporary housing when a covered event makes your home uninhabitable, such as loss of water, electricity, or heat. Some policies extend ALE for a limited period when a civil authority orders evacuation, even without direct damage to your home. Read the civil-authority clause before you assume it applies.
One boundary catches West Virginians every year: flood damage is typically excluded from standard homeowner’s policies. If flooding is causing or driving the emergency, only a separate National Flood Insurance Program policy purchased before the event will respond. Buying flood coverage after a disaster is declared does not help with that disaster.
If a Federal Disaster Declaration Follows
When damage exceeds what the state can handle, the Governor can request a federal disaster declaration from the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, which unlocks funding and programs the state cannot provide alone.3FEMA.gov. Stafford Act
For individuals, the relevant program is FEMA Individual Assistance. To qualify, you generally must be a U.S. citizen or qualified alien, the damaged home must be your primary residence, and you must have unmet needs that insurance and other programs have not already covered.4FEMA.gov. Eligibility Criteria for FEMA Assistance FEMA tries to verify ownership and occupancy through automated records searches, but you may need to supply documentation if those searches fall short. FEMA fills gaps insurance leaves; it does not duplicate what your policy already handles. If you have homeowner’s insurance, file that claim first.
IRS Tax Relief
When the IRS recognizes a federal disaster declaration affecting West Virginia, residents in the covered area typically receive automatic extensions on filing returns and making payments. The IRS applies relief based on your address of record, so most affected taxpayers do not need to call. If you live outside the declared area but your tax records are located within it, the IRS disaster hotline is 866-562-5227.5Internal Revenue Service. Relief typically covers individual and business income tax returns, estimated tax payments, payroll and excise tax deposits, and returns for estates, trusts, and tax-exempt organizations. You can also elect to claim disaster-related casualty losses on your federal return for either the year of the event or the prior year, which can pull a refund forward when cash is tight.5Internal Revenue Service. Refusing Dangerous Work
West Virginia has no state-specific emergency leave law, but federal OSHA rules give employees a narrow right to refuse dangerous work. All four conditions must be met: you asked your employer to fix the hazard and they refused, you genuinely believe an imminent danger of death or serious physical harm exists, a reasonable person would agree the danger is real, and there is not enough time to go through normal OSHA enforcement channels. If your employer retaliates, you must file a complaint with OSHA within 30 days.6Occupational Safety and Health Administration. Workers’ Right to Refuse Dangerous Work During an active declaration with mandatory travel restrictions or an evacuation order, the case for refusing to travel to work is stronger, but document every step: the request to your employer, their response, and the specific order you are complying with.
