WV WORKS is West Virginia’s TANF program, providing monthly cash payments to low-income families with children in exchange for meeting work requirements and signing a personal responsibility contract. Benefits are capped at a cumulative lifetime total of 60 months of cash assistance, counting every month of TANF you have received in any state.1West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 15.6 – Lifetime Limit for Receipt of Cash Assistance You apply through the WV PATH portal or your county Department of Human Services office.
Who Qualifies
Your household must include at least one dependent child. The assistance group is that child plus any parents or caretaker relatives living in the home.2Bureau for Family Assistance. WV WORKS You need to be a West Virginia resident and either a U.S. citizen or a qualified immigrant with proof of status.
Income eligibility is measured against a threshold set by household size and the federal poverty level. If anyone in the household earns wages, the state disregards 60% of that gross earned income before calculating what counts against the limit, which keeps the program reachable for families with low-wage jobs.3West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 10.24 – WV WORKS Income Because thresholds shift with household size, the reliable way to know where you stand is to apply or call your local office.
The state also looks at your countable assets: cash on hand, bank accounts, certificates of deposit, retirement accounts (minus any early-withdrawal penalties), and the current market value of vehicles beyond your primary car.4West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 11 – Assets Your home does not count. Cash that represents this month’s income does not count as an asset. Exceed the ceiling even slightly and you will not qualify for that benefit period.
How Much You Get
The monthly cash payment is based on your household size and your countable income after the 60% earned-income disregard.3West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 10.24 – WV WORKS Income If your household earns $1,000 a month in wages, the state ignores $600 and counts only $400 against the payment standard for your family size. The difference between countable income and that standard is your monthly benefit.
Payment standards rise with the size of the assistance group and are adjusted periodically. Your caseworker calculates the exact amount during the eligibility determination, and your approval notice states what you will receive and when funds land on your EBT card.
How to Apply
Applications use Form DFA-2, the standard form for WV WORKS and other benefit programs. You can pick up a paper copy at your county Department of Human Services office or apply online at wvpath.wv.gov.5WV PATH. Benefits Application An online account lets you track case status and upload documents directly.
Gather your documents first. You will need Social Security numbers for everyone in the household, proof of West Virginia residency such as a utility bill or lease, recent pay stubs or other proof of income, and documentation of monthly expenses including rent or mortgage and childcare. Incomplete applications are the most common reason for delays.
After you file, the state schedules a mandatory intake interview. From the date your application is received, the agency has 30 days to approve, deny, or withdraw it.6West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 1.25 – Application/Redetermination Process Approvals come with a written notice of benefit amount and payment date. Denials come with a written explanation and appeal information.
The Personal Responsibility Contract
Every adult receiving WV WORKS must sign a personal responsibility contract before cash benefits begin. Refusing to sign makes the entire family ineligible.7Justia Law. West Virginia Code 9-9-9 – Personal Responsibility Contract The contract is negotiated with your caseworker and spells out steps toward employment along with requirements to keep children current on preventive health care, ensure school attendance, arrange supervised childcare, and pursue child support when applicable.
Weekly work-activity hours depend on household type. Single-parent families must participate at least 30 hours per week.8Office of the Law Revision Counsel. 42 USC 607 – Mandatory Work Requirements Two-parent families face a 35-hour minimum, which rises to 55 hours if the family receives federally funded childcare assistance.9West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 24.3 – Minimum Hours of Participation Single parents with a child under age six have a reduced 20-hour weekly requirement.
Not every activity qualifies. Unsubsidized employment, on-the-job training, community service, and work experience placements carry the most weight. Vocational education and job skills training can fill remaining hours but cannot satisfy the full requirement on their own. Job search and job readiness activities are capped at roughly six weeks per year in most states.
Sanctions if You Don’t Comply
Missing work hours or violating your contract without good cause triggers escalating penalties rather than immediate termination:
- First violation: benefit reduced by one-third for three months.
- Second violation: benefit reduced by two-thirds for three months.
- Third or subsequent violation: benefit terminated for three months.
These sanctions apply to every type of program violation, from missing assigned hours to failing to cooperate with your caseworker.10West Virginia Legislature. Senate Bill 626 Enrolled – WV Works Program Sanctions A third sanction also makes the household temporarily ineligible for the separate Emergency Assistance program during the first three months of the penalty.11West Virginia Department of Health and Human Resources. WV Income Maintenance Manual Chapter 19.2 – Emergency and Special Assistance Programs If you had good cause for missing a requirement, raise it with your caseworker right away.
Support Services
Cash is not the only piece of the program. WV WORKS also funds support services aimed at removing practical barriers to holding a job. Most carry lifetime dollar caps, so plan their use with your caseworker.12West Virginia Department of Health and Human Resources. WV Income Maintenance Manual Chapter 24.14 – WV WORKS Supportive Services

The 60-Month Lifetime Cap
Federal law bars states from using TANF funds to give cash assistance to any family that includes an adult who has already received benefits for a cumulative 60 months.13eCFR. 45 CFR 264.1 – Time Limit for TANF Assistance West Virginia enforces this strictly. Any month you received a WV WORKS cash payment counts, regardless of the amount.1West Virginia Department of Human Services. WV Income Maintenance Manual Chapter 15.6 – Lifetime Limit for Receipt of Cash Assistance
The clock is national. TANF months from other states count against your West Virginia total. The limit applies to adults in the household; months you received as a dependent child in someone else’s case do not count against your own limit. Once any adult in the assistance group hits 60 months, the entire group loses cash eligibility.
Families who cycle on and off the program for short stretches often miscalculate here. Scattered months still accumulate. Ask your caseworker how many months you have used.
If You Are Denied or Sanctioned
You can request a fair hearing if your application is denied, your benefits are reduced, or your case is closed. The request must be made within 90 days of the effective date of the action.14West Virginia Department of Human Services. Fair Hearing and Conference Request Form File before a proposed reduction or closure takes effect and your benefits continue at the current level until a final decision. Signing the personal responsibility contract does not waive your right to challenge any of its terms.7Justia Law. West Virginia Code 9-9-9 – Personal Responsibility Contract
