ZYN Tax in Illinois: The 45% Rate, Base, and Online Buys

In Illinois, Zyn and other nicotine pouches are taxed at 45% of the wholesale price under the state’s Tobacco Products Tax Act, a rate that took effect July 1, 2025. That excise sits on top of regular state and local sales tax, and in Cook County and Chicago, additional local tobacco taxes apply as well.

What the 45% Is Calculated On

The 45% rate applies to the wholesale price, not the shelf price you pay. Under 35 ILCS 143/10-10, wholesale price means the manufacturer’s established list price to distributors, before discounts, trade allowances, or rebates.1Illinois General Assembly. Illinois Compiled Statutes 35 ILCS 143/10-10 If no list price exists, the manufacturer’s invoice price to unaffiliated distributors is used. Freight and other add-ons are not included in the calculation.

In practical terms, a can of Zyn that wholesales for about $4 picks up roughly $1.80 in state excise before it reaches a retail shelf. The distributor pays the tax, then passes the cost through the supply chain, so you see it baked into the shelf price rather than as a line item on your receipt.

The same 45% rate applies to cigars, smokeless tobacco, moist snuff, and electronic cigarettes. It replaced a previous 36% rate on traditional tobacco products, and the increase took effect on the same day nicotine pouches were brought into the tax.2Illinois Department of Revenue. Why Zyn Is Now Taxed

Before July 2025, Zyn escaped the Illinois tobacco excise entirely. The old definition of “tobacco products” under 35 ILCS 143/10-5 covered only products “made from or derived from tobacco,” and nicotine pouches use nicotine salts rather than tobacco leaf. Synthetic nicotine products fell outside the statute by design of the words it used.

The 2025 amendment rewrote the definition to include “any product that is made from or derived from tobacco, or that contains nicotine whether natural or synthetic, that is intended for human consumption or is likely to be consumed, including but not limited to nicotine pouches, lozenges, and gum.”3Illinois General Assembly. Illinois Compiled Statutes 35 ILCS 143/10-5 – Definitions Adding synthetic nicotine as a separate hook closed the gap, and Zyn was swept in on the first day the new language was effective.

One narrow exclusion exists, and it does not help Zyn buyers. Products approved by the FDA as smoking cessation aids or nicotine replacement therapy, and marketed and sold only for that approved purpose, remain outside the tax. That covers FDA-approved nicotine gum, patches, lozenges, and prescription inhalers.2Illinois Department of Revenue. Sales Tax and Local Tobacco Taxes

The 45% excise is only the state piece. At the register, standard sales tax also applies. Illinois’s state base sales tax is 6.25%, and local add-ons push the combined rate to somewhere between 6.25% and over 10% depending on where you buy.

Cook County imposes its own tobacco product tax on retail sales within the county, and that tax reaches products brought in under the state’s expanded definition.4Cook County Government. Tobacco Tax If you buy in Chicago, a city tobacco tax layers on as well. A Chicago shopper pays the 45% state wholesale excise, the Cook County tobacco tax, the Chicago tobacco tax, and the combined sales tax on top. That stack makes Chicago one of the most expensive places in the country to buy nicotine pouches.

Buying Zyn Online From Out of State

Ordering from an out-of-state seller does not get you out of the Illinois tax. Under the federal Prevent All Cigarette Trafficking (PACT) Act, remote sellers of nicotine products must register with the Bureau of Alcohol, Tobacco, Firearms and Explosives and with the tax administrators of every state they ship into, file monthly reports with each destination state, and comply with that state’s tax, licensing, and age-verification rules.5Bureau of Alcohol, Tobacco, Firearms and Explosives. Prevent All Cigarette Trafficking (PACT) Act A legitimate online seller shipping Zyn to Illinois should already be collecting and remitting the 45% state excise before the package goes out. A price that looks too low to include it usually is.

At the federal level, the Consolidated Appropriations Act of 2022 brought synthetic-nicotine products under FDA authority, and nicotine pouches now require a Premarket Tobacco Product Application before they can be legally marketed in the United States.6U.S. Food and Drug Administration.
